Javed Abidi Foundation v Union of India WP (C) 600/2021

 

Schools and colleges have moved to conducting classes and examinations online since the beginning of the pandemic. The Javed Abidi Foundation, a disability rights group, has filed a PIL to ensure accessibility of online school and examinations for students with disabilities. 

 

The petitioners argue that the state has failed to provide specific directions to educational institutions for making online learning accessible. This has made it difficult for students with disabilities to access lectures, reading material or individual learning support, where needed.  The petitioners suggest that the absence of reasonable accommodation denies students with disabilities their fundamental rights to education, equal opportunity and a life of dignity. 

 

This case is being heard by a two-judge Bench consisting of Justices Khanwilkar and Khanna
