The Supreme Court has begun to hear the batch of petitions challenging the constitutionality of various Muslim marriage customs. In particular, the petitioners are seeking for the Court to strike down the practices of polygamy, nikah halalanikah mut’ah and nikah al-misyar. 

 

Today, a Bench comprising Chief Justice Dipak Misra, Justice A.M. Khanwilkar and Justice D.Y. Chandrachud issued notice to the Union and its instrumentalities. It observed that the Ministry of Women and Child Development, Ministry of Minority Affairs and National Commission for Women would of particular help in assisting the Court. 

 

The Bench also referred the case to a Constitution Bench, the strength of which will be determined by the Chief Justice.
