Constitutionality of Waqf Amendment Act | Arguments Matrix on Interim Stay
Constitutionality of the Waqf (Amendment) Act, 2025Judges: B.R. Gavai J, A.G. Masih J
On 22 May, a Bench comprising Chief Justice B.R. Gavai and Justice A.G. Masih reserved judgement on whether to grant an interim stay on the Waqf (Amendment) Act, 2025.
The matter was heard over three days by the Gavai-led Bench, following two days of arguments before a Bench headed by former Chief Justice Sanjiv Khanna. These proceedings were among the most significant of the Court’s summer session.
While the petitioners argued that implementation of the Act would result in irreparable harm, the Union maintained that no such imminent injury had been demonstrated.
The matrix below summarises key arguments advanced during the hearings.
