Elevation of Justice Kureshi

The Supreme Court is hearing a petition contending that the Union’s delay in elevating Justice Kureshi is unconstitutional. The Union government has yet to respond to a collegium recommendation elevating Justice Kureshi to the office of Chief Justice of Madhya Pradesh High Court. The petitioners, the Gujarat High Court Advocates Association (GHCAA), argue that the delay is deliberate and politically motivated. In 2012, Kureshi J remanded current Union Home Minister Amit Shah to two days of police custody.

 

Today, Solicitor General Tushar Mehta once again asked for more time to respond on behalf of the Union government. He emphasised that Parliament is in session. In the previous hearing on July 22nd, Mr. Mehta had requested an adjournment of two weeks.

 

The bench led by CJI Gogoi emphasised that the court will not indefinitely wait for the Union to respond. Nevertheless, it granted the adjournment. The next hearing is on August 14th 2019.
