Reservation in Promotion

Our Pre-Judgement Matrix of the Reservation in Promotion case explains what the Court’s judgement might look like. The Court will look into whether reservations for SCs and STs should extend to promotions, by assessing its 2006 Nagaraj judgement. The Nagaraj judgement held that while the State can grant reservations in promotion, it must first test for three controlling conditions. This has made it difficult to grant reservations to Schedule Castes and Scheduled Tribes in matters of promotion.

 

The three controlling conditions require the State do the following when granting a SC/ST reservation in promotion:

  1. Demonstrate current backwardness
  2. Demonstrate inadequate representation in relevant public employment
  3. Maintain administrative efficiency
