Order issued by Court with respect to legislations that states must compulsorily register under to provide relief to migrant workers

Registration of Migrant Labourers by States

The Court delivered a comprehensive order on July 31st 2020. The court cited the order passed on June 9th 2020 and referred to the 3 enactments that States must necessarily register under in order to better facilitate relief to the migrant workers. These enactments were –

  1. Inter-State Migrant Workmen (Regulation of Employment and Conditions of Service) Act, 1979

  2. Construction Workers (Regulation of Employment and Conditions of Service) Act, 1996

  3. Unorganized workers Social Security Act, 2008

The court noted that while some states had made rules under these enactments, the necessary details hadn’t been brought to record and one of the states had filed affidavits. The bench ordered that in three weeks, all states and union territories must submit affidavits, responding with the steps they have taken under the three enactments.
