Day 2 Arguments

Elevation of Justice Kureshi

July 22nd 2019

The court is hearing a petition by the Gujarat High Court Advocates Association (GHCAA) against the Union government’s ‘deliberate inaction‘ in appointing Kureshi J as the Chief Justice of Madhya Pradesh High Court. The GHCAA claims that the Union government has violated the memorandum of procedure governing appointments and Article 217 of the Constitution.

Today, Solicitor General Tushar Mehta requested two more weeks to file a response on behalf of the Union government. He submitted that he had not yet received directions from the Union.

The three judge bench comprising CJI Ranjan Gogoi, Deepak Gupta and Aniruddha Bose JJ granted the Solicitor General’s request. The case was listed for 2 August.
