Constitutionality of the Electoral Bond Scheme

The Supreme Court is deciding whether the current electoral bonds scheme facilitates anonymous corporate funding to political parties and whether it was wrongly certified as a Finance Act. In the previous hearing back in April, the Court directed all political parties to file details of electoral bonds received with the Election Commission.

 

Today, Advocate Prashant Bhushan appearing for the Association for Democratic Reforms (ADR) mentioned the matter before a bench comprising Chief Justice S.A. Bobde, Justice B.R. Gavai and Justice Surya Kant. ADR has filed an application seeking a stay of the electoral bonds scheme.

 

Mr. Bhushan told the Court that the scheme was conducive to non-transparent political funding and compared it to money laundering.

 

Chief Justice Bobde said it would consider hearing the plea for a stay in January.
