Sabarimala Review

By a 3:2 majority, Court today directed that the issues raised in the Sabarimala review petitions be heard by a larger 7-judge bench. Court observed that similar issues such as women’s entry into mosques as well as female genital mutilation for religious purposes are also pending before other benches, and it would be opportune to club these issues to be heard by a larger bench.

Justices DY Chandrachud and Rohinton Nariman though dissented. Justice Chandrachud observed that there are only very narrow grounds available for allowing a review petition and such grounds had not been made out by the petitioners.

Justice Nariman too rejected the review petitions and also expressed his discontent at the manner in which the Court’s 2018 judgment was not given effect to.
