Tribunals Reforms | Argument Matrix

Tribunals Reforms Act, 2021

On 11 November 2025, a Bench of Chief Justice B.R. Gavai and Justice K.V. Chandran reserved judgement in a case challenging the constitutional validity of the Tribunals Reforms Act, 2021. The petitioners have argued that the Act has resurrected provisions that were previously struck down by the Court in the challenge to the Tribunals Reforms Ordinance, 2021. The provisions pertain to service conditions for tribunal  members, including aspects of eligibility criteria, tenure and selection process that have long been a subject of dispute between the executive and judiciary.

In this matrix, we have summarised the key arguments. Our hearing reports explain these arguments in greater detail.
